JUDGEMENT

(1.) THIS is an appeal filed under Section 96 of the CPC assailing the judgment passed against the appellant.

(2.) THE main ground urged in this appeal is that because of certain reasons beyond his control, the appellant could not appear and contest the case before the trial Court. In other words, the appellant is trying to contend that he has sufficient cause to show that he could not appear before the trial Court. If that be so, then the appellant had to actually approach the trial Court under Rule 13 of Order IX seeking to set-aside the ex-parte decree. Instead, such a ground is urged in an appeal filed under Section 96 of the CPC.
