(1.) BOTH these writ appeals are preferred against the order passed by the learned Single Judge, who in fact has remanded the matter to the Appellate Authority and after such remand has issued directions for removing the appellant- Tazeen Ruhi from service. Both these appeals are taken up for consideration together and disposed of by this common order.
(2.) FOR the purpose of convenience, the parties are referred to as they are referred to in W.P. No.13514/2006.
(3.) THE 6th respondent, who had also applied for the post of Hindi Teacher under backward class - Category I, challenged the selection of the petitioner to the said post before the Karnataka Administrative Tribunal, which was pending consideration. He preferred an appeal against the order passed by the 2nd respondent granting Validity Certificate to the 1st respondent Appellate Authority. The Appellate Authority quashed the Validity Certificate issued in favour of the petitioner. Aggrieved by the said order, the petitioner preferred the aforesaid writ petition. The learned Single Judge set-aside the order of the Appellate Authority on the ground that it has not applied its mind properly and therefore, remanded the matter back to the Appellate Authority for fresh consideration. Thereafter, he was of the view that the petitioner and her father have suppressed the truth from the Court. They have not come to the Court with clean hands and therefore, he directed the 4th respondent to discontinue her from the post for which she was selected.
