(1.) The petitioner who is said to be in custody for nearly ten months seeks bail and the offences alleged against him and other accused are under Sections 498A, 304B, 306 read with Section 34 of Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. Learned Counsel for the petitioner submits that the other accused are on bail and for more than ten months the petitioner is in custody and the death of the wife of the petitioner was due to she having committed suicide by hanging herself. Since the charge-sheet is also submitted, Learned Counsel for the petitioner seeks bail on the above ground.
(2.) Having considered the above submission and the learned Government Pleader also mentioning that the charge-sheet is filed and the opinion is pending with regard to the death note, the petitioner can be released on bail by imposing conditions to safeguard the prosecution interest:
