(1.) THE petitioners had joined the first respondent -College for the study of Five Year LLB Course. They have failed in the examination of some of the subjects of different semesters. Therefore, they were not permitted to join the next semester on account of the bar contained in the Regulations of the University. That is why the petitioners have filed these writ petitions to quash regulation 9(2) of the prospectus of the first respondent -college and for a mandamus directing the respondents to permit them to attend next semester and to write the examination.
(2.) LEARNED Counsel for the petitioners would contend that the petitioners had joined Five Year LLB Course when the college in question was affiliated to Bangalore University. After coming into force of the Karnataka State Law Universities Act, 2009, the college in question is deemed to have been admitted 10 the privileges of the Karnataka Slate Law University, Hubli. If the petitioners are not granted full carry over system, they may not be able to attend the classes after the academic year 2013 -2014 i.e after the last batch of the students admitted to the college in question when it was affiliated to the Bangalore University complete their course. Therefore, the petitioners should be permitted to complete the course by granting full carry over.
(3.) HAVING regard 10 the resolution referred to above, the University has to gram the petitioners full carry over till they complete the course. Therefore, the respondent -University is directed to grant the petitioners full carry over and allow them to appear for the examination in accordance with law Writ petitions are disposed of accordingly. No costs.
