Mahesh, learned counsel for appellant submits that a sum of Rs. 35,30,000/ - (Rupees Thirty Five Lakhs Thirty thousand only) has been remitted by the second respondent. Therefore, the appeal does not survive for consideration. His submission is recorded. The appeal is dismissed as having become infructuous.
