The State has preferred this appeal against the order passed by the learned Single Judge, who has issued a direction to the State to consider the appl ication f i led by the respondent on compassionate ground, if the vacancy is avai l able as early as possible, but not later than the outer limit of four months from the date of receipt of copy of this order.
(2.) The facts are not in dispute. One Mal lanna. S. Chichakandi was serving as Asst. Storekeeper in Water Works Department, Munirabad. On 20.09.1994 he expired whi le on duty. His widow f i led an appl ication on 21.4.1995 before the Competent Authority praying for appointment of her son - the respondent herein on compassionate ground after he attaining the age of majority. The petitioner was born on 28.5.1986 and attained the age of majority on 28.5.2004. Within one year from the date of attaining the majority, he fi led an appl ication for appointment on compassionate ground on 7.5.2005. The said appl ication was considered and as Group C post was not avai lable in the establishment, a recommendation was made for appointment in any other department. Thereafter, the appl ication came to be rejected on the ground that the appl ication is not fi led within the prescribed period of l imitation. The said order was chal lenged before the learned Single Judge.
