ISMAIL G K Vs. STATE BY MANGALORE

JUDGEMENT

(1.) PETITIONER has been arraigned as accused No.16 in CC No.1684/2012 on the file of JMFC, II Court, Mangalore.

(2.) ONE Abdul Rahiman @ Sana Puttha, S/o B.Hasanabba, resident of Kannuru Borugudde house, Kannuru village near Mangalore was murdered at about 7.00 pm on 13.03.2012. In respect of the said crime, CW-1 - Ummar Farooq, the elder brother of the deceased, lodged a report at about 8.30 p.m., on the same day and based on the said report, case in Crime No.65/2012 came to be registered by Mangalore Rural Police for the offences punishable under Sections 143, 144, 147, 148, 149, 302 r/w Section 149 IPC against 5 persons named in the complaint.

(3.) THE petition is opposed by the respondent- State. I have heard both the sides and perused the records made available.
