JUDGEMENT

(1.) LEARNED Government Pleader is directed to take notice for respondent Nos. 1 to 4. The memo for appearance to be filed within four weeks. The petitioner is before this Court seeking for issue of mandamus as prayed in the writ petition. Similar issue has been considered by this Court in several writ petition, in particular W.P.No. 265/2007, disposed of on 05.01.2007. This court on taking note of the earlier decisions of this court has held that the respondents would not entitled to interfere with the lawful activities of the petitioners and they shall not be insisted on securing license.

(2.) HOWEVER , the respondents should have liberty to -inspect and take action if there is any unlawful activities in the premises. Therefore in similar terms, the instant petition also stands disposed with a direction to the respondents not to interfere with the lawful recreational activities carried out by the members of the petitioner/ Society. If is however made clear that the respondents would be at liberty to take appropriate actions according to law if the petitioners or the members indulge any unlawful activities.
