(1.) HEARD the learned counsel appearing for the appellants. In the light of the statements made and for the reasons stated in the affidavit filed in support of the application, Misc.Cvl. is allowed.

(2.) DELAY of 269 days in filing the appeal is condoned subject to the condition that the appellants are not entitled to interest for the said period in the event of succeeding in the appeal.
