JUDGEMENT

(1.) WHEN the matter is taken up for hearing, learned Counsel appearing for respondents-defendants submits that the trial Court had dismissed O.S.No.3685/2007 for non prosecution on 20.3.2012. Therefore, this appeal filed against the interim order made in O.S.No.3685/2007 does not survive for consideration. The original suit is not pending. The appeal is accordingly dismissed.
