(1.) HIGH Court of Karnataka invited applications as per a Notification No.CJRC.1/2010 dated 6.8.2011 to 152 posts of "Civil Judges (the then Civil Judge (Junior Division)". The said Notification was published in the Karnataka Gazette. Candidates desirous of applying to the notified post were required to furnish the particulars in the prescribed form of applications (in duplicate) which were made available from the Office of the Secretary, Civil Judges Recruitment Committee. The last date for submission of filled in applications was 16.09.2011. Along with the application, instructions in the matter of filling up of the applications and submission of testimonials was made available in the form of 'Instructions to candidates'.
(2.) IN pursuance of the said Notification, petitioner, a practising advocate, submitted an application within the due date. On 15.02.2012, vide Annexure-C, she was intimated that her application has been rejected for not furnishing the character certificate in proper format. Petitioner submitted a representation vide Annexure-D, to the recruitment Committee, enclosing another character certificate. Said representation came to be rejected vide Annexure-E. Feeling aggrieved by the intimations of the Committee vide Annexures-C & E, this writ petition has been filed.
(3.) SMT . Manjula R. Kamadolli, learned High Court Government Pleader, appearing for the respondents, on the other hand contended that the petitioner having not submitted a proper 'character certificate' the decision of the Committee rejecting the candidature of the petitioner is neither arbitrary nor unreasonable. The character certificate enclosed with the application, produced as Annexure-B to the writ petition, is only a general certificate, which has not been issued in the letter-head of the Principal of the institution where the candidate last studied.
