JUDGEMENT

(1.) Petitioner joined the services of the State Government on 17 -12 -1953. He took voluntary retirement on 8 -4 -1981 at the age of 54 years, 10 months and 21 days after rendering the qualifying service of 27 years, 3 months and 21 days. At that time, his basic pay was Rs. 1,600.00 per month which was subsequently revised to Rs. 1,825.00 per month. The second respondent fixed the pension at the first instance as Rs. 670.00 per month and subsequently by order dated 20 -11 -1991, revised the pension to Rs. 755.00 per month.

The State Government by order dated 19 -1 -1994 directed that in respect of Government servants who had superannuated at the age of 55 years prior to 1 -12 -1985, pension should be calculated at 50% of the emoluments drawn at the time of retirement and the amount of pension so arrived at shall be related to 60 completed six monthly periods. Petitioner gave a representation dated 15 -6 -1994 stating that he may be extended the benefit of the G.O. dated 19 -1 -1994. The second respondent by communication dated Nil/3/1996 rejected the request on the ground that petitioner had not retired on superannuation at the age of 55 years. Petitioner thereafter gave one more representation dated 18 -3 -1996 to the first respondent and the first respondent also rejected the request on the same ground by communication dated 5 -9 -1996.

(3.) Feeling aggrieved, petitioner approached the Karnataka Administrative Tribunal in Application No. 4628/1997 and sought the following reliefs:
