DR. MANJUNATHA J. Vs. UNION OF INDIA

JUDGEMENT

(1.) Petitioner is an Insurance Medical Officer with the Labour Department, Government of Karnataka. He has submitted a representation on October 18, 2021 to the State Government with a request to send his name to the Union Public Service Commission ('UPSC' for short) for consideration of his candidature for the post of IAS. He did not get any response from the State Government. He has approached the Central Administrative Tribunal ('CAT' for short) in O.A. No.524/2021 with a prayer inter alia to direct the State Government to send his name for selection for IAS. After hearing the matter on November 2, 2021, the CAT has issued notice returnable on November 18, 2021. Petitioner has presented this writ petition with a prayer inter alia to set-aside the order passed by the CAT so far as, refusal to grant the interim order by the CAT.

(2.) Shri. M.S. Bhagwat, learned Advocate for petitioner submitted that as per his information, the last date to send the proposal is November 20, 2021. The next date of hearing at CAT is on November 18, 2021. If petitioner's case is not considered by then, he would lose his opportunity of being appointed to IAS. He submitted that in view of the peculiar facts, this Court may direct the State Government to send petitioner's name to the UPSC.
