JUDGEMENT

(1.) PETITIONER , owner of the industry carrying on business at APMC yard, Davanagere, having secured allotment of plot bearing No. A -1 -190 in the Agricultural Marketing yard, Davanagere, aggrieved by the notice dated 4/11/2008, Annexure -B, canceling the allotment, has presented this petition.

(2.) IN identical circumstances, this Court in other petitions granted nine months' time to put up construction and to submit a building plan for sanction within a week to be considered by the APMC in the week thereafter and pass orders according sanction to the plan in accordance with law and the Petitioner to file an undertaking in the form of an affidavit to the Court within a week.

(3.) PETITION is ordered accordingly. In the event of non -compliance with the direction of this Court, it is needless to state that the order dated 4/11/2008 Annexure -'B' shall stand revived.
