JUDGEMENT

(1.) THIS appeal by the claimant is directed against the impugned judgment and award dated 24th December 2008, passed in M.V.C. No. 166/2006, by the Civil Judge(Sr. Dn) and Additional Motor Accident Claims Tribunal, Channarayapatna, (for short, Tribunal') for enhancement of compensation on the ground that, the compensation of Rs. 46,000/ - awarded in favour of the claimant as against his claim for Rs. 01.50 Lakhs, is inadequate.

(2.) THE occurrence of accident at about 4:30 P.M. on 22/06/2006 and the resultant injuries sustained are not in dispute. It is also not in dispute that the Appellant was aged about 35 years as on the date of accident and hale and healthy prior to it.

(3.) I have heard learned Counsel for Appellant and learned Counsel for second Respondent Insurer, for quite some time.
