These Writ Petitions raising certain questions about or relating to promotional opportunities to the Petitioners and the contesting Respondents were directed to be taken up for hearing after disposal of other Writ Petitions, viz., W.P.1880/67 and seven others, raising questions relating to inter-state Seniority list of the same department, or more accurately, same section of the Department of Agriculture. The section or the category to which the contestants belong is one consisting of various posts going by the common name of Agricultural Demonstrators.
(2.) We have discussed the details relating to this department in our order dated 17th August 1970 in the said group of writ petitions, 1880/67 and connected cases. As pointed out therein the Agricultural Demonstrators in all the integrating units of this State, except Madras, were divided into two categories. No.1 and 2. We have also noticed that in the erstwhile State of Mysore after J949, the rules or the practice were so modified as to provide for appointments being made to the first grade either by promotion from the second grade or by direct recruitment to the first grade itself.

In the final interstate seniority list the second or junior grade of Bombay and Hyderabad were coalesced with the first grade, whereas the junior grades of Mysore and Coorg were left as they were. In our order of last week, we have expressed the opinion that for the reasons discussed in the said order the equations will have to be redone in accordance with law. As a result thereof the ranks assigned to the Petitioners in the said batch of writ petitions have been quashed and certain directions given both to the State Government as well as the Central Government for re-examining the position and modifying the final inter state seniority list according to the ultimate decision to be arrived at by the Central Government.
