JUDGEMENT

(1.) Learned AGA is directed to take notice for respondent Nos.1 and 2.

The petitioner contends that the petitioner's father was granted with a licence under the provisions of the Essential Commodities Licensing Order, 1986 in the year 1985-86 to distribute the essential commodities like kerosene oil to the card holders attached to his shop namely the FDP Point at No.110, A.M.Lane, I Cross, Kalasipalyam, Bangalore, the total number of cards attached to the petitioner's father shop was 650. Out of which, 613 are BPL cards, 14 are APL cards and 23 are AAY cards. On coming into force KEC (PDS) Control Order, 1992, authorization came to be issued by 2nd respondent to the petitioner's father under the said provision in the year 1993-94 which is being renewed once in three years and the same is valid till 31.12.2022.

(3.) Since the petitioner was unemployed, he was assisting his father in his day-to-day business of his father in respect of aforesaid shop. On account of the unfortunate demise of petitioner's father on 20.03.2020, the petitioner after obtaining no objection from his mother and sister who are the only other legal heirs of petitioner's father filed an application dated 30.04.2020 with the 2nd respondent which was received by 2nd respondent on 02.05.2020 seeking for transfer of authorization on compassionate ground to his name.
