JUDGEMENT

(1.) This is a petition filed by the petitioner / accused under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.78/2020 of Halasuru Police Station for alleged offences punishable under Sections 188 , 420 , 468 and 471 of IPC. The police are making hectic efforts to arrest this accused. Therefore, the counsel is praying to enlarge him on anticipatory bail in the event of his arrest on the grounds urged therein.

(2.) Heard the learned counsel for the petitioner and the learned HCGP for the State, through video- conferencing.

It is contended by the learned counsel for the petitioner during the course of his arguments by referring to the allegations made against the accused in Crime No.78/2020 that he is not involved in any criminal offence as narrated in the complaint. He is working as Project Engineer in a private company. He is an Electrical Engineer. On 14.04.2010, the Government had issued a notification declaring locked down in view of COVID-19 pandemic. It is submitted that the petitioner did not had the benefit of the notification or the guidelines issued by the Government. On the said date, petitioner was called by the Electrical contractor who is acquainted to an electrical maintenance personnel in the Bruhat Bengaluru Mahanagara Palike (for short ' BBMP' ) and requested the petitioner to attend to an immediate work relating to electrical connection in the BBMP office and the petitioner agreed to attend to the work. He was given a display board to be stuck to the vehicle which the petitioner was using to reach the place. When the petitioner reached Trinity Junction around 5.00 p.m. the police personnel had enquired about his movement and due to violation of guidelines as alleged and registered the same.
