(1.) Heard the learned counsel appearing for the appellant, the learned counsel appearing for the first respondent and the learned Additional Government Advocate appearing for the second respondent.
(2.) The appellant who is the third respondent has impugned the order dated 8th June 2020 passed by the learned Single Judge in a writ petition filed by the first respondent herein.
(3.) With a view to appreciate the submissions made across the Bar, it is necessary to make a brief reference to the facts of the case. The dispute concerns a male child born on 11th December 2010. Initially, the present appellant was not a party to the petition filed by the first respondent. Admittedly, the appellant is the father of the minor child. The first respondent has filed a petition invoking Sections 8 and 9 of the Guardian and Wards Act , 1890 in the Court of the Additional City Civil Judge at Bengaluru praying to appoint him as a guardian of the minor child. The said petition is pending. In the said petition, the first respondent claimed that the appellant and his wife had handed over the custody of the minor child to him and right from January 2014, he is looking after and taking care of the minor child. It is pleaded in the petition filed by the first respondent before the City Civil Court that the present appellant came to his house on 23rd March 2019 and asked for the custody of the child and in fact, he had gone to the police station for seeking custody of the child.
