(1.) The present respondents No.1 and 2, joined by their mother Smt. Nirmala as petitioner No.3, have instituted a petition in Crl.Misc.No.121/2013 under Section 125(1) of the Cr.P.C., against the present petitioner in the Court of the learned Judicial Magistrate First Class at Hungund (hereinafter referred to as the trial Court , for brevity), wherein they had claimed a maintenance of Rs.18,000/- per month from the respondent therein (the petitioner herein). According to them, the present petitioners are the minor children and their mother Smt. Nirmala (petitioner No.3 in Crl.Misc.No.121/2013) is the wife of present petitioner Shankargouda. Since all three of them have been deserted by the present petitioner, they had sought for the maintenance of Rs.18,000/- per month from him.
(2.) In the said petition, they had also filed an interlocutory application under Section 125 (2) Cr.P.C. seeking an interim maintenance at the rate of Rs.15,000/- for the petitioners therein. The trial Court by its order dated 31.05.2013, held that the petitioners No.1 and 2 before it (present respondents No. 1 and 2) were entitled for an interim maintenance at the rate of Rs.5,000/- per month. Challenging the same, the present petitioner, who was the respondent in the said criminal Misc.No.121/2013, filed a criminal revision petition in the Court of the II Addl. District and Sessions Judge, Bagalkote (hereinafter referred to as the Revisional Court , for brevity) in Criminal Revision Petition No.68/2013, which after hearing both side, by its impugned order dated 07.08.2017, dismissed the said petition, while confirming the order of the trial Court dated 31.05.2013. Challenging the same, the present petition has been filed by the petitioner.
