JUDGEMENT

(1.) Heard the learned counsel for the petitioner and the learned High Court Government Pleader, and perused the records.

(2.) The petitioner stands trial for the offences punishable under section 397 read with section 34 of the Indian Penal Code, 1860 [' IPC ' for short] in S.C. No.886/2019 on the file of the LIX Additional City Civil and Sessions Judge, Bengaluru. The petitioner's application for bail under section 439 of the Criminal Procedure Code, 1973 [' Cr.PC ', for short] in Criminal Misc. No.1794/2019, the first application filed by the petitioner midcourse trial, is rejected by Order dated 27.03.2019. As such, the petitioner is before this Court.

(3.) The prosecution's case against the petitioner is that Sri. Ratheesh, son of K.H. Murthi, has lodged a complaint on 28.01.2019 stating that he was informed by unknown person that his brother was seriously injured and he should immediately rush to Fortis Hospital. When he reached the Fortis Hospital, his injured brother told him that when he had stopped at 80 feet road, Chandra Layout, to answer nature's call, some unknown persons forcibly took his mobile [worth Rs.8,000/-] and when he resisted, he was stabbed in the abdomen.
