(1.) This is a claimant's appeal seeking enhancement of the compensation.
(2.) The claimant aged 37 years and employed as a conductor in a private school was loading beds and bed sheets on to a lorry to distribute them to the participants of National Level Volley Ball Tournament. While he was carrying the bed and crossing the road on NH-206 in Birur town, a car bearing registration No.KA:03/MA-3990 dashed against the claimant. As a result of the accident, the claimant sustained the following injuries.
(3.) After the accident, the claimant was administered first-aid and thereafter shifted to Nanjappa hospital, Shimoga and was discharged on 09.01.2009. The claimant underwent treatment at Government Hospital, Birur and then again on 21.03.2011, 15.04.2011, 21.04.2011 and 01.07.2010, he was treated as out-patient at Nanjappa Hospital. Due to psychiatric issues, the claimant was referred to Mc.Gann Hospital and was clinically examined by Dr.Sanjay and Dr.Ballal as well as Dr.A.R.Krishna Murthy, Psychiatrist. He claimed that as a result of the injuries sustained in the accident, his mental faculty has debilitated and he could not carry on with his regular activities. The claimant contended that he was 37 years at the time of the accident and was earning Rs.5,000/- per month.
