B R NAGARAJA GUPTA Vs. D N NAGARAJ

Decided On January 25, 2010
B. R. NAGARAJA GUPTA Appellant
V/S
D. N. NAGARAJ Respondents

JUDGEMENT

(1.) THE respondents filed a petition under Section 27(2)(b) & (r) of the Karnataka Rent Act, 1999 (hereinafter called as 'the Act' for short), seeking eviction of the petitioner-tenant. On contest, the trial Court allowed the petition under Section 29(2)(r) of the Act and granted a period of three months to vacate the premises. Aggrieved by the same, the tenant has preferred this petition.

(2.) SRI Ambaji, learned counsel appearing for; the petitioner submits that there is no case made out by the landlord and hence, the impugned order suffers from substantial errors. He contends that the landlord has failed to show that the premises is required for his bona fide use and occupation and hence an error is committed by the trial Court. He further contends that, he has been in occupation of the premises for the last 26 years and if he vacates the premises immediately, his business will suffer. Hence, considering his petition on merits, he prays for time to be granted for vacating the premises.
