JUDGEMENT

(1.) This Writ Petition challenging the selection of the third respondent to the post of System Analyst/System programmer in the first respondent University, is by the petitioner who was unsuccessful at the selection.

The first respondent called for applications inter alia for the post of System Analyst/System Programmer, for which the educational qualification prescribed is at least second class Master decree in Computer Science/Application with two years teaching experience or at least second class Master degree in any discipline with Post Graduate Diploma in Computer Science/post Graduate Diploma in Computer Application with two years experience. The petitioner offered himself for selection for the said post, in the year 1992. Though the interview was completed, the first respondent-University thought fit not to proceed with the selection process and dropped it. Subsequently for the same post, fresh applications were called for.

(3.) The first respondent, after processing the applications, prepared a list of candidates for interview and called them for interview in the order of merit. The petitioner stood first with 75.78 per cent of marks. In the order of merit, the third respondent Humnabad Eranna was placed 8th. The petitioner claims, that at the interview held on 16-11-1994, he had performed very well and expected to be selected for the post. However, he later came to know that third respondent had been selected. The petitioner claims that the third respondent Humnabad Eranna was not entitled to be selected on merits, as the entire procedure adopted by the University was erroneous in law. The appointment of the third respondent, it is alleged, is based on Extraneous and irrelevant considerations. The petitioner, in the circumstances, seeks quashing of the Notification Annexure-A dated 19- 11-1994 and for a direction to select and appointment the petitioner to the post of the System Analyst/Programmer.
