BULTI CHAKRABORTTY Vs. DEBJIT SADHUKHAN

JUDGEMENT

(1.) As per Office Report dated 9-1-2019, service is complete on the sole respondent but nobody has entered appearance on his behalf so far.

(2.) This petition under Sec. 25 of the Civil Procedure Code, 1908 read with Order XLI of the Supreme Court Rules, 2013 has been filed by the petitioner (wife) for transfer of H.M.O.P. No.117/2017 titled as "Debjit Sadhukhan vs. Bulti Chakraborthy" pending before the Court of Subordinate Judge at Kanchipuram, Chennai to the District Judge, Bankura, West Bengal.

(3.) After having heard the learned counsel appearing for the petitioner and taking into consideration the grounds taken in the transfer petition, we direct transfer of H.M.O.P. No.117/2017 titled as "Debjit Sadhukhan vs. Bulti Chakraborthy" pending before the Court of Subordinate Judge at Kanchipuram, Chennai to the District Judge, Bankura, West Bengal.
