(2.) The respondent, Havildar-Sarwan Singh, stood retired from the Army service on 31.03.2008 on completing 26 years of service.

(3.) The controversy which has been raised is whether he was eligible to be promoted as a Junior Commission Officer (a Gazetted Post) in the rank of Naib Subedar with increased service and consequential benefits which have been granted by the Courts below.
