(2.) Without commenting on the merits of the cases, we find that the High Court while deciding discharge has appreciated the evidence and looked into its probative value. It is not the function of this Court at this stage.
(3.) In the facts and circumstances and evidence on record, the respondents could not have been discharged. The impugned orders are set aside and the appeals are, accordingly, disposed of. We direct the Trial Court to proceed in accordance with law.
