CHITRA DUTT Vs. SURESH MALI

JUDGEMENT

(1.) As per Office Report dated 9-1-2019, service is complete on the sole respondent but nobody has entered appearance on his behalf so far.

(2.) This petition under Sec. 25 of the Civil Procedure Code, 1908 read with Order XLI of the Supreme Court Rules, 2013 has been filed by the petitioner (wife) for transfer of H.M.P. No.732/2017 titled as "Suresh Kumar Mangilal Mali vs. Chitra Dutt Suresh Mali" pending before the Court of Family Judge at Ahmedabad (Gujarat) to the Family Court at Ajmer (Rajasthan) or to any other competent Court of Civil Judge at Ajmer (Rajasthan).

(3.) After having heard the learned counsel appearing for the petitioner and taking into consideration the grounds taken in the transfer petition, we direct transfer of H.M.P. No.732/2017 titled as "Suresh Kumar Mangilal Mali vs. Chitra Dutt Suresh Mali" pending before the Court of Family Judge at Ahmedabad (Gujarat) to the Family Court at Ajmer (Rajasthan) or to any other competent Court of Civil Judge at Ajmer (Rajasthan).
