JUDGEMENT

(1.) Having heard learned counsel for the parties, it appears that the complaint which was filed by the respondent against the petitioners has been going on merrily from 1983 till 1988. The respondent-complainant says that he only wants to examine one witness - a Doctor which very necessary in this case. in our opinion an appropriate course will be that the Magistrate should fix a date for examination of the prosecution witnesses. The respondent-complainant should keep all his witnesses present on that date and court should proceed to dispose of the case in accordance with law expeditiously. In this view of the matter, we direct both parties shall remain present before the learned Magistrate on 9th of May, 1988. It is further directed that the respondent-complainant may do the needful about the filing of process or any other thing which he wants from the court for summing witnesses within ten days from today, failing which no further opportunity shall be granted to the respondent-complainant. It is further directed that the learned Magistrate shall examine all or any of the witnesses, who reminiscent on that date and thereafter shall proceed to dispose of the matter within two months from that date.

(2.) The Special Leave Petition is disposed of accordingly.
