(2.) We have heard the learned counsel for the appellant - State of Madhya Pradesh. None has appeared on behalf of the respondent - accused in spite of due service of notice.

The respondent-accused was convicted by the learned trial Court under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 ("NDPS Act" for short) and sentenced to undergo rigorous imprisonment for five years and fine of Rs. 25,000/-, in default, to undergo additional rigorous imprisonment for one year. The contraband in question is 'ganja' and the total quantity was 1 kg. 100 gms.
