(1.) LEAVE granted. Admittedly in the present case the High Court has not complied with the provisions of Sec. 100 of Civil Procedure Code while deciding the substantial question of law.

(2.) HENCE, the impugned judgment is set aside. The matter is remitted to the high Court. Regular Second Appeal No. 4759 of 2001 stands restored to the file of the High Court. High Court is requested to dispose of the appeal as expeditiously as possible, preferably, within one year. This appeal is disposed of.
