JUDGEMENT

(1.) We are not at all satisfied by the counter-affidavit dated 2/01/1987 sworn by Shri S. M. Srivastava. We are of the opinion that the matter has not been properly considered. The order refusing the prayer for premature release betrays lack of application of mind to the relevant considerations. We, therefore, direct the respondents to reconsider the petitioner's case latest by 28/02/1987 and to take afresh decision on principle in accordance with law giving full reasons in support of the said decision. Meanwhile the petitioner shall be released on parole for three months. The matter shall be listed in the first week of March 1987.
