JUDGEMENT

(1.) Leave granted. Having heard the Learned Counsel for the parties, we are of the opinion that the learned Magistrate could not have dismissed the complaint petition only on the basis of police papers. The matter is therefore remitted to the Court of learned Magistrate who shall proceed with the matter in accordance with law. We may observe that it would be open to the Appellant to examine herself as also the witnesses on her behalf. We, however, make it clear that we have not entered into the merit of the matter.

(2.) The appeal is disposed of with aforementioned observations and directions.
