JUDGEMENT

(1.) LEAVE granted. In this case on 18/2/2005 a limited notice was issued as to why on payment of costs the written statement be not taken on record. The learned Senior Counsel for the appellants submits that she is willing to pay the costs. We fix the costs at Rs. 2000.00 to be paid by the petitioner to the respondent. On payment of Rs. 2000.00 the written statement filed by the defendants beyond 90 days shall be accepted.

(2.) THE order of the trial court as well as of the High Court are accordingly set aside. The Appeal is Disposed of.
