(2.) Heard learned Counsel for the respective parties.

(3.) On 28th November, 2008, we had issued notice on the special leave petition and had allowed the application for impleadment of the complainant as party to the proceedings, having regard to the submissions which had been made that the parties had compromised the matter between themselves. It has been jointly submitted by the appellant and the added respondent that the quantum of sentence could be considered in that background.
