(1.) THIS Court had initially entertained the grievance expressed by the persons claiming to be of Pakistan origin who were detained in various jails. From time to time orders have been passed under which those persons who had served their sentences have since been repatriated. Subsequently it was reported that there were some children who also claimed to be Pakistani nationals who were being detained in juvenile homes/prisons. The respondents are now submitting an affidavit in which it is stated that consular access had been provided to the two children in November 2004. However, the Pakistani authorities had not yet confirmed that the children were Pakistani. Having regard to this fact, we dispose of the matters by directing the respondents to remind the Pakistani authorities requesting them to take accessary decision in this regard. Any further consular access, if so required must be granted.
(2.) IN the event the Pakistani authorities recognise the children as being Pakistani, they will be repatriated forthwith.
