(2.) LEARNED counsel for the rival parties are agreed that the impugned order dated 23.06.2006 passed by the High Court be set aside, and that, the objections filed by the appellant on 31.03.1999 be directed to be re -adjudicated by the Assistant to the Deputy Commissioner, Shillong, under Sections 30 and 33 of the Arbitration Act, 1940.
