JUDGEMENT

(1.) Leave granted.

(2.) This appeal, by special leave, is directed against the judgment and order passed by the High Court of Judicature of Bombay in W.P. No. 307 of 1998, dated 22.07.2008, whereby and whereunder the High Court has dismissed the petition filed by the appellant.

(3.) The facts in brief are: The appellant is a retired personnel of Indian Navy. He had joined the Indian Navy as Aviation Cadet in October 1971. He was commissioned as Sub-Lieutenant in the Executive Branch (Pilot) on 02.06.1973, thereafter, he was promoted to the rank of Lieutenant Commander.
