(2.) THIS is an appeal by special leave from the decision of the Punjab High court dismissing an appeal under the Letters Patent against the judgment of Gosain J" in a writ petition.
(3.) WE would like to point out that the appellants had themselves accepted the order dated 9/10/1951, as being a final order because in their petition to the High court they had asked for its cancellation. It was only during the arguments that a contention was raised on their behalf that the order was not final. In our opinion, they cannot be permitted to raise a contention which is clearly contrary to the stand taken by them to their writ petition.
