JUDGEMENT

(1.) This special leave petition also arises out of the same judgment and order of the High court which is impugned in Special Leave Petition (Civil) no. 11531 of 1989 which we have disposed of today after granting leave. In view of our decision in the said appeal preferred by the State of Bihar against the very same impugned order we do not consider it necessary to pass any separate orders in this special leave petition preferred by some of the intervenors wherein respondents Nos. 3 to 9 who are the original petitioners in the writ petition before the High court have raised a preliminary contention that the intervenors have no right to prefer an appeal. We do not consider it necessary to decied this technical objection because by our order in the States appeal the impugned judgment of the High court does not survive. We, therefore, make no order in this special leave petition by the intervenors. The same shall stand disposed of accordingly
