JUDGEMENT

(1.) This appeal by special leave arises from the judgment of the Karnataka High Court in Civil Revision Petition No. 528/ 84. The High Court held that the respondent-land lord has satisfied the requirements of clause (1) of section 21(1) of the Karnataka Rent Control Act, 1961, (Act No. 22 of 1961). The High Court found:

(3.) Evidence had been let in by the landlord as to his requirements in the trial court. No evidence had been let in on the side of the tenant. However, the burden of establishing any one of the grounds mentioned in the proviso to Section 21(1) is upon the landlord.
